Terms of Service

By accessing or using EmailOS ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age, or if you are under 18, that you have obtained parental or guardian consent to use the Service.

EmailOS is a visual email builder that allows users to: • Upload design images and convert them to HTML emails • Create clickable hotspots and interactive elements • Export production-ready HTML code • Host images via integrated CDN services • Access premium features through paid subscriptions We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

Account Registration: • You must provide accurate, complete registration information • You are responsible for maintaining account security • You must notify us immediately of any unauthorized access • One person or legal entity per account Subscription Terms: • Basic Plan: Free, includes core features with EmailOS branding • Pro Plan: $29/month, includes all features, white-label export • Billing is recurring unless cancelled • Prices are subject to change with 30 days notice Cancellation: • You may cancel at any time from your account settings • Cancellation takes effect at the end of current billing period • No partial refunds for unused time

We offer refunds under the following conditions: • Within 14 days of initial purchase if you haven't used the premium features extensively • If the Service was unavailable for more than 72 consecutive hours • At our discretion for extenuating circumstances To request a refund, contact support@EmailOS.dev with your account email and reason for the request. We do not offer refunds for: • Renewals after the initial 14-day period • Accounts terminated for Terms violations • Partial months of service

You agree NOT to use EmailOS to: • Send spam, phishing emails, or unsolicited bulk email • Create emails for illegal purposes or promoting illegal activities • Distribute malware, viruses, or malicious code • Infringe on intellectual property rights of others • Harass, abuse, or harm other individuals • Impersonate any person or entity • Collect personal information without consent • Violate CAN-SPAM, GDPR, or other applicable laws • Create content involving minors inappropriately • Promote hate speech, violence, or discrimination We reserve the right to terminate accounts violating these terms without refund.

Your Content: • You retain all rights to content you upload • You grant us a license to host and display your content to provide the Service • You represent that you have rights to all content you upload • You are responsible for any copyright violations in your content Our Content: • EmailOS branding, code, and design are our intellectual property • You may not copy, modify, or distribute our proprietary code • Generated HTML email code is yours to use freely • The Service itself may not be reverse-engineered or replicated

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee: • That emails will render perfectly in all email clients • Uninterrupted or error-free service • That all features will always be available • Specific deliverability rates for your emails LIMITATION OF LIABILITY: In no event shall EmailOS be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless EmailOS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: • Your use of the Service • Your violation of these Terms • Your violation of any third-party rights • Content you upload or create using the Service • Emails sent using our exported HTML code This indemnification obligation survives termination of your account.

Informal Resolution: Before filing any formal dispute, you agree to contact us at legal@EmailOS.dev and attempt to resolve the dispute informally for at least 30 days. Governing Law: These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Arbitration: Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by: • Posting the new Terms on this page • Updating the "Last Updated" date • Sending an email to your registered address for material changes Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the modified terms, you must stop using the Service.
